2. Use of the Site

You may use our Site for lawful purposes only. You agree not to:

• Violate any applicable laws or regulations

• Engage in harmful, fraudulent, or disruptive activities
• Attempt to interfere with the proper functioning of the Site

We reserve the right to suspend or terminate your access if you violate these Terms.

3. User Accounts

Certain features of the Site require you to create an account.

You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

You must immediately notify us if you believe your account has been compromised.

4. Paid Subscriptions and Billing

• Some features require a paid subscription.
• Payments are securely processed through Stripe under Toast Media FZCO.
• Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on the plan you select).
• By providing payment information, you authorize us (and our payment processors) to charge the applicable subscription fees.
• Prices and features may change over time, and we will notify you of significant changes in advance.

5. Cancellation and Refunds

• You can cancel your subscription at any time through your account settings.
• Your cancellation will take effect at the end of the current billing cycle.
• We do not offer prorated refunds for partially used billing periods.
• Exceptions to our refund policy may be granted at our sole discretion.

6. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, and software, is the property of Toast Media FZCO or its licensors.

You may not copy, modify, distribute, or create derivative works based on our content without our prior written permission.

7. Disclaimer of Warranties

Our Site and services are provided "as is" and available" without warranties of any kind, either express or implied.

We do not guarantee that the Site will be error-free, uninterrupted, or meet your specific needs.

8. Limitation of Liability

To the fullest extent permitted by applicable law:

• Toast Media FZCO will not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claims arising out of or related to your use of the Site shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Third-Party Services

The Site may contain links to third-party websites or services that are not owned or controlled by us.

We are not responsible for the content, policies, or practices of any third-party sites or services.

10. AI-Generated Content

Some of our tools, including Content Studio, our AI writing tools and the LLM Tracker, produce text and images with artificial intelligence. AI output can be inaccurate, incomplete or out of date, and may resemble content produced for other users.

You are responsible for reviewing, editing and checking the facts in anything we generate before you publish it or rely on it, and for making sure it complies with the law, the rules of the platforms you publish on, and the rights of others.

As between you and us, you own the articles and other content generated for you, to the extent the law allows. You give us permission to store and process your content and the information you provide so we can run the service for you.

Only submit material you have the right to use. Instructions, notes, transcripts and files you add must not infringe anyone else's rights.

11. Content Studio and Publishing

• Content Studio researches, plans, writes and can publish articles for the websites in your projects, using monthly allowances that depend on your plan.
• If you switch on automatic generation, articles are written on their scheduled day without further review from you and count against your allowance.
• If you connect a website (for example WordPress), you authorise us to create and update posts and upload media on that site on your behalf. You control and can revoke that access at any time. We store connection details encrypted.
• You are responsible for everything published to your website through the service, including articles written automatically.
• To research and plan content, we may read your public website and sitemaps and the pages that rank in search results for your keywords.

12. Backlink Exchange

The Backlink Exchange is an optional feature, currently in beta. By switching it on for a project you agree to the following:

• Hosting links: we may add up to two links per article, each to a relevant page on a different member's website, on phrases already in your text. You can remove them from a draft before you publish. If you switch on Add links to my published articles, we may also add them to articles already live on your WordPress site, changing nothing else in the post.
• Keeping links live: once published, a hosted link should stay on the page as a normal followed link. We check published pages automatically, and your credits may change if a link is removed, changed, or marked nofollow, sponsored or ugc.
• Receiving links: other members' articles may link to your pages. We do not control, endorse or guarantee other members' websites, their content, or how long their links stay in place.
• Eligibility and matching: taking part depends on criteria such as Domain Rating, organic traffic, language, topic and type of site, which we may change. We may decline, pause or remove any website, including free blog platforms and sites with inappropriate content.
• Information shared: your domain, Domain Rating, and the titles and addresses of pages available to receive links may be shown to other members and used for matching.
• No guarantees: we do not promise any number of links, rankings, traffic or particular treatment by search engines. Search engines may regard link exchanges as against their guidelines. You take part at your own risk, including the risk of ranking changes or penalties, and you are responsible for following the guidelines and laws that apply to your website.
• Fair use: manipulating the exchange is not allowed, for example using fake or duplicate websites, removing links after they are credited, or hiding or cloaking links. We may reverse credits, stop matching your website, and suspend or end your participation.
• Leaving: you can switch the exchange off at any time. Links already published stay on the pages that host them unless their owners remove them.

13. Credits and Allowances

• Backlink Exchange credits, article credits, research requests and other allowances are units for using features of the service. They have no cash value and cannot be sold, transferred or exchanged for money, and they are not refundable except where the law requires.
• Exchange credits are earned by hosting links that we have verified, may be added monthly on some plans, and may be bought where we offer this. We may set and change how credits are earned, charged, capped and carried over, and we may correct credits given in error or through misuse.
• Backlink Exchange credits you buy in a pack never expire and stay usable if your plan changes or ends, while your account is open; monthly plan credits are used before them. If your subscription ends or is downgraded, other unused credits and allowances, including monthly plan credits, may be reduced or lost.

14. Governing Law

These Terms are governed by the laws of the Dubai International Financial Centre (DIFC) or applicable UAE law, without regard to conflict of laws principles.

Any disputes shall be resolved exclusively in the competent courts of Dubai, United Arab Emirates.

15. Changes to These Terms

We may update these Terms from time to time.

The most current version will be posted on our Site with the updated Effective Date.

Your continued use of the Site after any changes indicates your acceptance of the new Terms.
